Truck Drivers Under the Influence

Professional truck drivers must obtain a commercial driver’s license (CDL) in accordance with the Federal Motor Carrier Safety Administration’s Commercial Driver’s License Program.

Under the heading of Major Violations While Operating a Motor Vehicle, the first violations include:

  1. Being under the influence of alcohol as prescribed by State Law
  2. Being under the influence of a controlled substance
  3. Having an alcohol concentration of 0.04 or greater while operating a CMV
  4. Refusing to take an alcohol test as required by a State or jurisdiction under its implied consent laws

It is a criminal offense to drive a commercial vehicle while under the influence of alcohol or drugs.

Disqualification for DUI

According to the State of Nevada Department of Motor Vehicles, as per the federal regulation 49CFR 383.51, a commercial driver’s license holder who receives a DUI conviction will experience suspensions:

  • A Commercial Driver’s License will be suspended for one full year
  • Or three full years if carrying hazardous materials, for a first offense,
  • And a lifetime suspension upon a second or subsequent offense.
