Overloaded Trucks

It really all comes down to one simple fact: trucks that are overloaded with cargo are more susceptible to accidents than trucks that are not overloaded. An overloaded truck can cause many problems, including the following:

  • Cargo that is stacked too high raises the center of gravity – and the likelihood of a truck rollover
  • When there is too much cargo in the truck, the tires are stressed from carrying too much weight and are more likely to explode, rupture or shred
  • Too much cargo requires more time to stop the truck; additionally, brakes are rated to carry specific amounts of weight
  • Brakes are unable to stop an overloaded truck in a timely manner

If you were injured by or in an accident with a truck that was overloaded, you may seek compensation for damages caused by this form of negligence. Attorney Paul VanDerwerken offers a complimentary case review to go over your legal options.

Improperly Secured Cargo in Overloaded Trucks

Cargo must be properly secured using the appropriate equipment. In an enclosed truck, if the cargo is not packed, stacked and tied properly, the contents can easily move around, shifting from side to side. This can lead to a number of accidents:

  • The truck can fall to one side or another, jackknifing and causing an extremely dangerous situation for the vehicles driving behind the truck. Multiple-car pileups are frequently caused by this type of accident.
  • Improperly loaded trucks can cause spillage. Spillage occurs when the contents of the truck fall out of or off of the truck.
  • Tarps and tie downs must be checked for wear. If these materials are not strong enough to properly tie down and cover the load, shifting can occur – as well as spillage and vehicle rollovers.
